Know Your Rights When it Comes to Sexual Harassment Training

Times have changed in the workplace. No longer is it acceptable behavior for crude jokes and foul language. Everyone has the right to work in an environment free from sexual innuendo and harassment. Employees in any job have the right to feel safe from sexual or abusive conduct. However, it is a fact sexual harassment workplace incidents have and do happen. If an employee is being victimized from either a co-worker, a supervisor, or even a manager, it can create what is called a hostile environment. This makes it difficult for the employee to perform job duties in manner that is productive.

Sexual harassment in the workplace can de defined as demands for sexual favors in return for job promotions or continued employment, making off-color jokes, using vulgar words for specific parts of the body, touching inappropriately, and other types of negative behavior that makes it difficult to stay focused on one's job. Most people think that it is only unwanted or inappropriate touching, but it includes both physical contact and verbal comments.

This type of behavior is illegal in most states and if you are the victim on the receiving end of such behavior, then you have legal rights under the law. And, if you were fired or laid off from a job because you reported such conduct or complained about it, you may be entitled to be reinstated to your position and may be entitled to any lost wages. You may even be able to sue for emotional distress.

Ideally, you will never need a sexual harassment attorney. If you feel you are being harassed at the work place, you will report it and management will resolve the issue for you. Unfortunately, this is not often the case. You may be forced to go outside your company to get the issue resolved if management ignores your report or refuses to take action. When looking for this type oft lawyer, look for one who is experienced in the courtroom with these kinds of cases. You want this type of experience just in case you need to go to trial.

Your harassment lawyer will typically review your case with you and the specific incidents which you reported. They will go over the laws that govern your state. Their first course of action will usually be in the form of a written letter to the company, advising them of the infraction and requesting them to take the appropriate action. If this fails, then they will usually file a lawsuit on your behalf. This is usually enough to get management's attention and the matter is typically settled quickly. Most companies do not want the bad publicity of a lawsuit. However, in a small number of cases, your lawsuit will go before a judge who will decide whether or not you have been wronged and what compensation you are entitled to.

Sexual harassment in the workplace is not appropriate and should be reported immediately. In most cases, management will take care of the matter and resolve it. However, in some cases, it may be necessary to hire an attorney to settle the matter in court. You have rights under the law to protect you from such disrespectful behavior and a good lawyer will advise you of your rights and make sure that you are protected.
